A proposed Settlement has been reached in a class action lawsuit against Un=
iversity of Hawai=E2=80=98i (=E2=80=9CDefendant=E2=80=9D). The lawsuit asse=
rts claims against Defendant related to the alleged unauthorized access to =
or acquisition of individuals=E2=80=99 private information discovered in Au=
gust 2025 (the =E2=80=9CData Incident=E2=80=9D). Defendant denies it did an=
ything wrong, and the Court has not decided who is right. The Parties have =
agreed to settle the lawsuit (=E2=80=9CSettlement=E2=80=9D) to avoid the ri=
sks, disruption, and uncertainties of continued litigation. A copy of the S=

The purpose of this Notice is =
to provide information about this Settlement and explain your rights and op=
tions.
Who is includ=
ed in the Settlement Class? The Court has defined the Settleme=
nt Class as =E2=80=9CAll living individuals within the United States who we=
re notified that their Private Information was potentially compromised in t=
he Data Incident.=E2=80=9D
Excluded from the Settlement Class are (1) the judges presiding over this A=
ction, and their immediate family members for whom participation would resu=
lt in a conflict of interest for the judge; (2) the Defendant, its affiliat=
es, subsidiaries, successors, predecessors, and any entity in which Defenda=
nt has a controlling interest, and any of its current officers and members =
of the Board of Regents, and their immediate family members for whom partic=
ipation would result in a conflict of interest for the officer or Regent; a=
nd (3) Settlement Class Members who submit a valid request for exclusion pr=
ior to the Opt-Out Deadline.
